Terms of Service

By accessing or using TYPE3 ("the App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the App.

These Terms of Service apply to all users of the App, including visitors, registered users, and contributors of content.

TYPE3 is a fitness challenge application that allows users to:

• View and attempt 100 athletic challenges across various fitness categories
• Submit video or photo proof of challenge completions
• Track personal progress and achievements
• View leaderboards and other users' public achievements
• Share accomplishments on social media

Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the App settings.

Your Submissions

You retain ownership of content you submit (videos, photos, text). By submitting content, you grant TYPE3 a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App and for promotional purposes.

Content Guidelines

You agree not to submit content that:

• Is fraudulent, false, or misleading
• Infringes on any third party's intellectual property rights
• Contains nudity, violence, or offensive material
• Violates any applicable law or regulation
• Depicts dangerous activities performed unsafely

We reserve the right to remove any content that violates these guidelines and to reject or revoke approval of any submission at our discretion.

All challenge submissions are subject to review and approval. We reserve the right to:

• Approve or reject any submission at our sole discretion
• Request additional proof or clarification
• Revoke previously approved submissions if fraud or violation is discovered
• Modify challenge requirements at any time

Approval of a submission indicates that the submitted proof appears to meet the challenge requirements. It does not constitute verification of the accuracy of any claimed results.

You agree not to:

• Submit fraudulent or manipulated proof of challenge completion
• Create multiple accounts to manipulate rankings or achievements
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Use the App for any illegal purpose
• Interfere with or disrupt the App's functionality
• Scrape, data mine, or collect user information without consent

The App and its original content (excluding user-submitted content), features, and functionality are owned by TYPE3 and are protected by international copyright, trademark, and other intellectual property laws.

The TYPE3 name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TYPE3. You may not use such marks without our prior written permission.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, TYPE3 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

You agree to defend, indemnify, and hold harmless TYPE3 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
